Terms of Service

These Terms of Service ("Terms") govern your use of ReadyBench.live (the "Service"), operated by Matthew Salvoni, a sole proprietor based in Texas ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. The Service

ReadyBench.live is a real-time event-tracking tool for swim meets. Meet creators can sign in, create meets, and share a unique link. Spectators and updaters may view and update meet information without creating an account.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement.

3. Account Registration

Meet creation requires signing in with a Google account. You are responsible for maintaining the security of your Google account and for all activity that occurs under it. Access to meet creation is granted at our sole discretion and may be revoked at any time.

4. Subscription and Payment

Certain features require a paid subscription at $149 per year. Payment is processed securely by Stripe. By subscribing, you authorize us to charge your payment method for the applicable fee.

All fees are in U.S. dollars.

5. Refund Policy

All subscription fees are non-refundable except at our sole discretion. We may issue a refund in cases of a verified service outage or significant service failure, or if you are genuinely dissatisfied and contact us within 30 days of your purchase. 6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Submit false, misleading, or harmful meet information
Attempt to interfere with or disrupt the Service or its infrastructure
Attempt to gain unauthorized access to any part of the Service
Scrape, crawl, or otherwise systematically extract data from the Service

7. User Content

You retain ownership of any meet information you submit (meet names, locations, dates, team names, and event numbers). By submitting content, you grant us a limited license to store and display it solely for the purpose of operating the Service. You represent that any content you submit does not violate any third-party rights.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MATTHEW SALVONI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.

12. Changes to These Terms

We may update these Terms from time to time. We will notify registered users by email of any material changes. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
